Your order at www.pumpkinseedoil.cc is an offer to pumpkinseedoil.cc to conclude a purchase contract and is submitted by clicking the button "buy now".

It is only when the offer is accepted by pumpkinseedoil.cc that the purchase contract is concluded and a claim for delivery of the goods arises. The order confirmation which is sent automatically by pumpkinseedoil.cc does not constitute acceptance of your offer. Instead the acceptance of your offer is made by sending the shipping confirmation to the email address you have provided.

Sales are only made in commercial quantities and only to adults, ie persons who have reached the age of 18.

You may not pass on the password for your pumpkinseedoil.cc account to a third party. For any orders with your password and any resulting claims you will be taken.

The prices offered are gross prices in Euro and include all taxes and duties for delveries within the European Union. For deliveries outside of the EU, the prices are net prices without Austrian VAT (Reverse Charge System).

We do not require a minimum order quantity.

For deliveries outside of Austria, additional duties and/or charges may apply, including any import or export charge or any consumption tax that may lead to a change in the prices offered. Such duties and/or charges shall be borne by the buyer. 

Deliveries outside of Austria can only be made if there are no legal or disproportionate logistical obstacles to the delivery.

(1) If you are a consumer (within the meaning of the Consumer Protection Act) you may declare the withdrawal from the purchase contract within 14 days from the date of receipt of the goods in accordance with §§ 11 FAGG. In case of partial deliveries the deadline starts with receipt of the last product. It is sufficient to send the withdrawal notice within this period. A withdrawal from the purchase of several goods, which are delivered in combination with a flat rate is only possible as a whole not with certain units of the combination only.

(2) In the case we fail to comply with our information requirements under the Austrian KSchG, the withdrawal period shall be extended to 12 months from the date of receipt of the goods. If, however, we meet our information requirements late within this period, the period of 14 working days for the withdrawal right begins to run with the date of the transmission of the information by us.

(3) The cost of returning all goods shall be borne by the customer. The declaration of withdrawal may be in any form, but must be in writing (eg by postal letter or e-mail). The withdrawal information must be sent to pumpkinseedoil.cc, Customer Service, Riegelberg 25, 7542 Gerersdorf or via E-Mail to service@pumpkinseedoil.cc.

For hygienic reasons we can only accept unopened, originally packed and undamaged goodes upon presentation of the original invoice. The redemption takes place at the price valid at the time of the original purchase. Excluded from the return are residual sale items as well as partial quantities of packaging units or sets. You have to return the goods immediately and in any case no later than 14 days from the day on which you informed pumpkinseedoil.cc of the withdrawal to the following address:

(4) In case of an effective cancellation we will refund the payments you have made. pumpkinseedoil.cc has the right to refuce the refund payment until the product has arrived at pumpkinseedoil.cc or if you have proof that you have returned the goods, whichever is earlier. You must pay for a possible loss of value of the goods only if this loss is attributable to a handling which is not necessary for the examination of the quality, characteristics and functioning of the goods.

(5) Keep the shipping document as proof.

(6) Returns which are returned to pumpkinseedoil.cc outside the withdrawal right period can not be processed. Any costs incurred for return or re-dispatch are to be borne entirely by the customer.

(1) pumpkinseedoil.cc is entitled to deliver partial deliveries. For all other than the first delivery, pumpkinseedoil.cc has to carry the resulting additional shipping costs.

(2) We usually ship orders within 5 working days, except for business holidays. 

If, without our falt, we are not in position to supply the ordered goods because a supplier of pumpkinseedoil.cc does not fulfill its contractual obligations, pumpkinseedoil.cc is entitled to the buyer to withdraw the contract.

Use and risk shall pass to the buyer as soon as the goods are delivered by the delivery agent. When handing over the goods, the buyer has to check the goods immediately for transport damages and must have a written confirmation of transport damage by the carrier. Only then we can claim a damage compensation at the carrier.

In cooperation with Klarna we offer the payment on invoice as a payment option. The payment period for Klarna invoices are 14 days from the date of invoice. (2) In the event of default interest of 9 % p.a. over the basic interest rate are to be paid. For the reminder operating costs a flat rate of 60 Euro will be charged. This amount increases with an order of more than 300 Euro with another 50 Euro. If a collection agency has to be commissioned, the costs will be no more than the amount determined by the Austrian BGBl. 141/96 ergibt. And if an attorney is employed, 50 Euro per out-of-court-reminder are charged, if the costs are appropriate and necessary for appropriate legal prosecution. If an exploration of the address is necessary, these costs plus 45 Euro will be charged.

(3) All delivered goods remain the property of pumpkinseedoil.cc until full payment.

(4) The purchase price is due with the order. The invoice will be sent by email.

(5) The right to se-off is only granted to the ordering end consumer if his counterclaims are legally established, recognized by pumpkinseedoil.cc or are legally linked to the liability of the customer. Companies are not entitledd to offfset any claims or to withhold the purchase price.

(2) The product images do not always have to match the appearance of the delivered product. In particular, changes in the appearance and the equipment of the products may occur after the manufacturer has rebuilt the product. Warranty rights do not exist for such minor changes if it affect sthe conditional or customary properties, if the product can be used according to the description and if such minore changes are therefore reasonable for the customer.

Compensation for damages resulting from a breach of an obligation arising from the contractual relationship shall be made under the legal requirements. The same applies to claims under the Product Liability Act. Observe all instructions on packaging and enclosures. No liability is assumed for any other application or handling. If the customer is entrepreneur, pumpkinseedoil.cc is not liable for slight negligence or for lost profits.

(1) Austrian law applies to the exclusion of the UN purchase law.

(2) Complaints can be made at the address given in § 1.

(3) The place of contractual fulfillment and exclusive court of jurisdiction for both parties is Güssing, Austria.

(4) If individual provisions of the contract or these terms are invalid, this does not invalidate the entire contract or the entire terms and conditions result. The remaining contractual content or the remaining general terms and conditions remain unchanged.

(5) Only the competent court in Güssing, Austria shall be responsible for the decision of all disputes arising in connection with the contractual relationship.
